Fleet driver training is designed to help company vehicle drivers to become safer drivers, save fuel & as a result lower the risk of an accident or claims on insurance. Also, raising the company profile to show a more professional approach to driving. This helps lower the company costs directly & reduces time spent ill or even from stress related causes linked through driving.
The training is based on the Police Roadcraft manual which is a much more advanced way of driving than the normal Learner test.
Your company is issued with a Risk Assessment certificate & related paperwork to show that particular driver has been assessed & trained to a safe standard of driving. This Risk Assessment will satisfy current Health & Safety laws to show that the Companies Duty of Care to their employee is satisfied.
If you employ more than five employees you should have a written policy to cover your employees work related road safety. Have you?
Legal
NEW HEALTH & SAFETY LAW: As from 16/01/2009. Company directors & Managers who ignore the management of employees driving for work (risk assessment & management) could face up to 2 years in prison or a fine of up to £20,000.00 imposed by a Magistrates Court. This comes after the Corporate Manslaghter & Homicide Act implemented in 2008 to hold directors & managers legally responsible for death caused by one of their workforce while driving for work.
The Health and Safety at Work etc Act 1974 requires you to ensure, so far as is reasonably practicable, the health and safety of all employees while at work. You also have a responsibility to ensure that others are not put at risk by your organisation’s work-related driving activities.
(see HSE - DfT guidance ‘Driving at Work’ (http://www.hse.gov.uk/pubns/indg382.pdf).
Under the Management of Health and Safety at Work Regulations 1999, you have a responsibility to manage health and safety effectively. You need to carry out an assessment of the risks to the health and safety of your employees, while they are at work, and to other people who may be affected by their work activities. The Regulations require you to review your risk assessment periodically so that it remains appropriate. They apply to all organisations, without exception.
Since 2004 police road accident investigators are specifically instructed to consider corporate liability.
HSE (Health & Safety Executive) have a right to look into any accident caused by company drivers to assess who is at fault in an effort to reduce the risk of this happening again. They can visit the drivers company to check that the individual has received any training in their driving & look at the companies duty of care to decide if they are at fault. This can result in a large fine or inprisonment for individual directors.
The true costs of road accidents to organisations are nearly always significantly higher than the resulting insurance claims. HSE research into workplace accidents generally (The Costs of Accidents - HSG96) suggests that, for every £1 recovered through insurance, between £8 and £36 may be lost via uninsured costs.
